Uni 14-04-2016 - Guidance on tax policy for regular investment activities

Official letter 769/BTC-TCT guiding on determining indicators of regular investment activities during 2009-2013, not be expansion investment activities and entitled to CIT incentive that project is applying as follows:

-          Regular investment activities are activities conducted from 1 of 3 independent sources including:

+        Depreciation of fixed assets of enterprises.

+        Using profits after tax to reinvest.

+        Using capital in investment capital scope registered with authorities.

-          The additional investments to regular machinery, equipment from the mentioned above does not make capacity increase for project being entitled to CIT incentive. In case, project scope is stated in investment certificate,  regular investment activities increase in scope more than in investment certificate are not regarded as regular investment and not entitled to CIT incentive. If project scope is not stated in investment certificate or machinery, equipment is added, replaced and not as stated in investment certificate, it will not be applied.
