OFFICIAL LETTER NO. 23620/CT-TT & HT DATED 28 DECEMBER 2018 OF THE BINH DUONG TAX DEPARTMENT GUIDING THE ENVIRONMENTAL TAX
Official Letter No. 23620/CT-TT & HT dated 28 December 2018 of Binh Duong Tax Department instructing the environmental protection tax as follows:
- In case the Company has imported raw materials such as mineral oil, additives to produce lubricating oil, make cutting oil, anti-rust oil, oil circulating oil for production and business, then subject to environmental protection tax at the stage of importation, the Company is requested to contact the Customs Office to be instructed to declare and pay taxes in accordance with regulations.
- In case the company buys mineral oil, additives from domestic suppliers as raw materials to produce lubricants, if the supplier has the function of trading petroleum and has paid environmental protection tax at the import stage, then When selling to the domestic market, the company does not have to declare and pay environmental protection tax.
- In case the Company buys mineral oil and additives from domestic suppliers if they have not paid the rent to protect the environment and when the Company buys for production and business, when selling to the domestic market, the Company must declare and pay environmental protection tax.
- In case the company buys mineral oil, additives for trade and purchase, the Company does not have to declare and pay tax to protect the environment.
From 01 January 2019, the Environmental Protection Tariff is issued together with Resolution No.579/2018/UBTVQH14 of 26 September 2018 of the Standing Committee of the National Assembly.
