OFFICIAL LETTER 10315/BTC-TCT DATED 25 JULY 2016 OF GDT GUIDING LAW NO. 106/2016/QH13 ABOUT VAT, SPECIAL CONSUMPTION TAX AND TAX ADMINISTRATION REVISION LAW
According to official letter 10315/BTC-TCT guiding VAT refund and late payment level in accordance with Law No.106/2016/QH13 as follows:
In case, business establishments have outstanding deductible VAT amounts incurred before July 2016 or quarter III/ 2016, qualified to refund VAT as regulations of clause 1 article Circular 219/2013/TT-BTC, tax authority still gets their VAT fund proposal file and solve them as regulations.
For outstanding deductible VAT amounts incurred before 01 July 2016 but after 01 July 2016 still not yet submitted, from 01 July 2016 applied to late payment of 0,03%/day.
In case, tax payers declare to lacked amounts of tax period incurred before 01 July 2016 but after 01 July 2016, authorities detect through inspection, examination or tax payers self-detect, applied to late payment of 0,05%/day (or appropriate level as regulations of corresponding period) from the payable day until the end of 30 June 2016 and 0,03%/day from 1 July 2016 until the date that tax payers pay to State budget.
