Official letter No 15273/CT-TTHT on compensation when terminating the labor contract as follows:
In case the company and the employee agree to terminate the contract ( 3 months above), the amount of compensation that paid to the employees shall not be included in taxable income of the employee in accordance with the regulations of the Labor Law and Social Insurance Law. If the allowances, benefits are higher than the prescribed level, the amount of excess shall be included in the taxable income of the employees.
